UIGEA - the end game?

So they finally published the regulations. Timed to be law the day Bush leaves office (hoorah!!!). As expected it’s still a pigs ear. There are many articles on the web about it, so rather than try and explain it I will simply muse on some bits and pieces. It is, as we all know, a ridiculous law, poorly defined and ultimately unfit for purpose. Despite all that, it will be promulgated as a swansong to Bush. Of passing interest is some of the comment at the top where the feedback on the drafts is considered.

“After carefully considering the comments, the Agencies have adopted a final rule to implement the Act. In accordance with the Act, the Agencies have consulted with the Department of Justice during the development of the final rule. The Agencies also conducted further outreach to gather information on the issues raised in the public comments.” - therein lies the real truth. The DOJ has been running its own version of the law for ages now, with the arrests of high profile individuals such as David arruthers and Peter Dicks (none of these have resulted in a court decision in favour of the prosecution). They seem to have an almost unhealthy infatuation with the notion that they can make their own laws.

On the issue of whether to publish a list of the “bad boys” …

“The first step in including a business on such a list would be to ensure that the particular business was, in fact, engaged in activities deemed to be unlawful Internet gambling under the Act. The Act,
however, does not set out the precise activities that are covered by the term, but refers to activities that are unlawful under other Federal or State gambling laws for such determinations. Creating such a list would require the Agencies to formally interpret those laws that are written and enforced by other entities, such as State legislatures and law enforcement agencies.”

So - the Agency cant work it out yet the banks are still required to.

Here’s a great piece of legaleze that will upset the many poker players hoping for exemptions on the basis of it being a skill game …

“The Agencies note, however, that a careful reading of the statutory language of the Act may be instructive in discerning Congressional intent regarding what constitutes a “game subject to chance.” The Act defines the term “bet or wager” as including a “game subject to chance.”29 However, the Act also defines the term “bet or wager” as including the purchase of a chance or opportunity to win a lottery or other prize (which opportunity to win is predominantly subject to chance).”30 The fact that Congress used “subject to chance” in one paragraph and “predominantly subject to chance” in the next paragraph in the same subsection suggests that Congress intended the element of chance in “game subject to chance” to be less than predominant. The Agencies believe that if Congress
had intended chance to be the predominant factor in determining the outcome of a “game subject to chance,” Congress would have inserted the word “predominantly” as it did subsequently in the same section. Therefore, even if chance is not the predominant factor in the outcome of a game, but was still a significant factor, the game could still be deemed to be a “game subject to chance” under a plain reading of the Act.”

Great! The act is ambigiuous and poorly worded. So rather than clarify it we take the view that it must have been implied that poker is illegal otherwise “Congress would have inserted the word “predominantly” ” (that is if Congress even read it)!

It goes on - a monstrosity of a law for a monstrosity of an act. God bless America!

UIGEA - the saga continues

You may remember House Financial Services Committee Chair Barney Frank’s attempt to put some logic into the insane US anti gaming law (UIGEA - the one that was snuck into law attached to the terrorist act)? Frank recognises the law for what it is - an ambigous and illogical piece of legislation - and attempts to sort it out.

Frank heard that there are attempts to fast track the regulations (that should have been done over a year ago) to enforce UIGEA so that they are put through before the current incumbent makes way for “change”. He has now written to the Treasury Secretary Henry Paulson requesting he postpone issuing the regulations. Here is the text of the letter:

“Dear Mr. Secretary:

I am deeply disappointed to hear that your agency is proceeding with what I consider to be unseemly haste in issuing regulations implementing the Unlawful Internet Gambling Enforcement Act. This midnight rulemaking will tie the hands of the new Administration, burden the financial services industry at a time of economic crisis, and contradict the stated intent of the Financial Services Committee

As you know, at our April hearing, the testimony of your representatives and the industry indicated that it would be particularly difficult to craft workable regulations to effectively enforce the statute without having a substantial adverse effect on the payments system. Subsequently, my colleagues and I introduced legislation (HR 5767, later HR 6870) that would prohibit the implementation of these flawed rules and replace them with a formal rulemaking process that would define the term “unlawful internet gambling,” something the proposed rules fail to do. HR 6870 was passed by the Financial Services Committee on September 16. The proposed regulations, like the underlying UIGEA statute, fail to define the term “unlawful internet gambling,” leaving it to each financial institution to reconcile conflicting state and federal laws, court decisions and inconsistent Department of Justice interpretations when determining whether to process a transaction. Furthermore, some of the information needed to make this determination would likely be unavailable to banks because customers or financial institutions in foreign jurisdictions will likely be unwilling or unable to provide it.

I strongly urge you to delay implementation of these major, and deeply flawed regulations to permit the incoming Administration the ability to review the consequences of such a significant policy decision, rather than unfairly being denied that opportunity.”

I have to say that it is refreshing to see Frank’s efforts on this and I wish him every success!

Indeed 2007 proved to be Devilfish’s most successful year ever in terms of tournaments with over $1.25 million in winnings. As a result he won the prestigious Card Player European Player of the Year title.
He is the top earning English tournament poker player in the history of the game.

Internet Skill Game Licensing and Control Act

Here is a press release from the Poker Players Alliance regarding the latest attempt to sort out the mess left behind by UIGEA…

WASHINGTON, DC. (October 1, 2008) –The Poker Players Alliance (PPA), the leading poker grassroots advocacy group with more than one million members nation-wide, today commended Senator Robert Menendez (D-NJ) for introducing S. 3616, the Internet Skill Game Licensing and Control Act. The legislation establishes the needed licensing and regulatory framework for the United States to exercise appropriate control and oversight over Internet poker and other games of skill.

“This action by Senator Menendez is yet another example that prohibitions on Internet gambling, and specifically poker, will not work to protect consumers,” said PPA Chairman and Former Senator Alfonse D’Amato. “The PPA has long advocated for thoughtful and effective licensing and regulation of online poker as a means to protect vulnerable communities, such as children and compulsive gamblers, and provide appropriate controls to thwart consumer fraud and abuse. Senator Menendez legislation is the right vehicle to achieve those goals.”

Until now legislative action in this area has been limited to the U.S. House of Representatives with Chairman Barney Frank (D-MA), sponsor of H.R. 2046, and Representative Robert Wexler (D-FL), sponsor of H.R. 2610, leading the charge for licensed and regulated poker. Senator Menendez’s bill is an exciting new development and a welcome legislative proposal of which millions of American poker players can be proud.

The introduction of S. 3616 follows a recent bipartisan victory in the House Financial Services Committee where legislation, H.R. 6870, was passed requiring clarification of the vague definition of “unlawful Internet gambling” contained in the 2006 Unlawful Internet Gambling Enforcement Act (UIGEA). Industry and regulators, including the Federal Reserve and Department of Treasury, testified to the unworkable nature of UIGEA as passed and the burden it places on the already troubled banking industry. S 3616 would provide even more clarity to the murky UIGEA and would relieve the banking industry from the ill-advised and costly burden of attempting to police private conduct at this critical economic moment in our nation’s history.

Key provisions of the bill include:

• Thorough vetting of potential licensees;
• Mandatory implementation of technologies to protect against underage gambling and to monitor and detect individuals with excessive gaming habits;
• High standards to thwart fraud and abuse of customers;
• Regulation to prevent money laundering; and,
• Processes to prevent tax avoidance.

“On behalf of the members of the PPA and online poker players nation-wide, I would like to thank Senator Menendez on his leadership on this important issue. We look forward to working with him and his Senate colleagues to enact this sound public policy,” said D’Amato.

Mansion moves to iPoker Network from Ongame

Mansion Poker has moved to the iPoker network. iPoker is one of the top 3 networks now, operated by Playtech.  I have been a Mansion player for some time (even in the old days when they had their own room) and have always enjoyed good support and games although the level of play is quite high.

Their tournaments over the past year have been phenomenal, with huge overlays. I hope they continue that on the new network.  I will certainly be giving it a go!
